Attending a visa interview at a U.S. Consulate can be a nerve-wracking and confusing process. Consular officers encounter more than 100 visa applicants per day and have as little as 2 minutes to render a decision on each application. The process includes reviewing the application, interviewing the applicant, conducting security checks, and documenting case notes. Unfortunately, this can lead to imperfect decisions and, as a result, improper visa denials. Once an erroneous decision is rendered, the process for correcting it can be very difficult.
SGG has successfully worked with clients and Consular posts around the world to resolve all types of issues relating to visa denials. In a recent case, our client urgently required the services of a uniquely skilled scientist in the United States to work on a large scale project. Unfortunately, he was refused entry at the border while trying to enter under the Visa Waiver Program. SGG attorneys prepared a J-1 visa application for the employee and communicated the urgency of the project to the adjudicating Consular officer. The scientist’s application was granted and he was admitted to commence work on the project.
In another case, SGG successfully helped a client obtain an immigrant visa after her I-130 petition had been pending at the U.S. Consulate in Riyadh, Saudi Arabia for 10 years due to unsubstantiated fraud claims. She was ultimately able to reunite with her family in the United States after the issuance of her visa.
SGG attorneys also had success assisting an E-2 client whose previous visa application was denied. SGG attorneys worked closely with the client to prepare her for the Consular visa interview, including the types of questions she might encounter. When she returned for her Consular interview, she was able to clearly articulate the basis of her eligibility for the visa. The Consular Officer approved her application and she was able to operate her new business in the United States.
